1. Introduction
These draft terms describe the proposed rules for participation in the Kiburon Affiliate Program. They must be reviewed and approved before the program is published or opened to affiliates.
2. Eligibility
Applicants must be legally able to enter an agreement and operate a genuine content, publishing or community channel suitable for Kiburon. Kiburon may assess eligibility individually.
3. Application and acceptance
Submitting an application does not guarantee acceptance. Participation begins only after Kiburon provides written approval. Application information must be accurate and kept current.
4. Affiliate relationship
Affiliates act as independent participants and are not employees, agents, franchisees or legal representatives of Kiburon. Affiliates may not bind Kiburon or make commitments on its behalf.
5. Commission rate
Approved affiliates may earn 10% commission on qualifying sales attributed to their unique referral link, subject to these Terms and the implemented tracking system.
6. 30-day tracking window
The referral tracking window is 30 days from a qualifying referral click. A purchase within that period may be eligible for commission, subject to attribution, validation and the other rules in these Terms.
7. Attribution rules
Referral attribution is determined by Kiburon’s implemented tracking system. These Terms do not promise first-click or last-click attribution. When multiple affiliates, advertising campaigns, coupon sites or other sources are involved, the tracking system determines the qualifying referral.
8. Qualifying purchases
A qualifying purchase must be completed, validly paid, attributable to an approved affiliate and remain valid after the applicable return and refund period. Only eligible product value determined by the final program setup is commissionable.
9. Non-qualifying purchases
Refunded, returned, cancelled, fraudulent, artificial, self-referred, improperly attributed or otherwise invalid purchases do not qualify for commission.
10. Returns and refunds
Commission connected to a returned or refunded purchase is not payable. Unpaid commission will be removed from the pending balance. If commission has already been paid, any adjustment against future earnings may be made only where the final approved Terms and applicable law permit it.
11. Cancelled orders
Cancelled orders do not qualify for affiliate commission.
12. Self-referrals
Affiliates may not earn commission on purchases made by themselves through their own referral links, including purchases intended primarily to generate commission.
13. Discount codes and promotions
Eligible public Kiburon discount codes may generally be used with affiliate referrals unless a specific promotion states otherwise. Discount code use does not guarantee affiliate attribution or commission.
14. Monthly payouts
Eligible approved commissions are scheduled for payment monthly using the payment method supported by the final program setup.
15. €50 minimum payout threshold
A payout is made only when the affiliate’s approved commission balance reaches at least €50. Approved balances below the threshold may carry forward to a later payout cycle.
16. Commission validation period
Commission becomes eligible for payout only after the applicable return and refund period has passed and Kiburon has validated the underlying order as completed and qualifying.
17. Fraud and abuse
Fraudulent transactions, artificial referrals, misleading activity, tracking manipulation and other attempts to improperly obtain commission are prohibited. Affected commission may be cancelled and participation may be suspended or terminated.
18. Prohibited promotional methods
Affiliates may not use spam, deception, forced clicks, cookie stuffing, false claims, unauthorized incentives or any unlawful or misleading promotional method.
19. Paid advertising and branded keyword restrictions
Without prior written authorization, affiliates may not bid on ‘Kiburon’, misspellings of Kiburon, Kiburon product names or other protected branded search terms. Affiliates may not create advertising, websites or social profiles that falsely appear to be official Kiburon properties.
20. Intellectual property and Kiburon brand usage
Approved affiliates receive a limited, revocable and non-exclusive permission to use authorized Kiburon materials solely to promote the program. Materials may not be altered in a misleading way, sublicensed or used to imply ownership or official status.
21. Affiliate disclosures
Affiliates must clearly disclose their affiliate relationship wherever required by applicable advertising, consumer protection or platform rules. Responsibility for accurate and sufficiently prominent disclosure rests with the affiliate.
22. Data and privacy
Applicant and affiliate information is handled in accordance with the existing Kiburon Privacy Policy. Affiliates must also handle any personal information they collect lawfully and securely.
23. Account suspension or termination
Kiburon may suspend review, participation or tracking while investigating compliance concerns and may terminate participation for a material breach, fraud, misuse of the brand or other conduct contrary to the final program rules.
24. Outstanding commission after termination
Valid approved commission earned before termination may remain payable subject to the €50 threshold, validation, adjustment rights and the final approved Terms. Fraudulent or non-qualifying commission is not payable.
25. Changes to the Affiliate Program
Kiburon may update program terms, rates, tracking, promotional permissions or operational requirements. The final Terms should specify how material changes are communicated and when they take effect.
26. Limitation of liability
Any limitation of liability must be reviewed for compliance with applicable law and approved by qualified legal counsel before publication. Nothing in the final Terms should exclude liability that cannot lawfully be excluded.
27. Governing law
The governing law and dispute venue have intentionally been left open and must be completed using Kiburon’s verified legal entity and jurisdiction information after legal review.
